END USER LICENSE AGREEMENT (EULA)
App: Birthday Plus

This End User License Agreement ("EULA") is between you ("End User") and Mind Foundry Studio ("Publisher"), and not with Apple. The Publisher, not Apple, is solely responsible for the Birthday Plus app and its content.
1. Acceptance
By downloading, installing, or using the App, you agree to this EULA. If you do not agree to this EULA, do not use the App.
2. Scope of License
The Publisher grants you a personal, non-exclusive, non-transferable, and revocable license to use the App on Apple devices you own or control, in accordance with applicable Apple services usage rules. This license does not transfer any intellectual property rights in the App to you.
3. Use Restrictions
You agree not to:
- copy, modify, adapt, distribute, sell, or sublicense the App, except where expressly permitted by law;
- decompile, disassemble, or attempt to extract source code, except where allowed by law;
- use the App for unlawful purposes or in violation of third-party rights.
4. Subscriptions and In-App Purchases
The App may offer auto-renewable subscriptions through the App Store.
- Payment is charged to your Apple ID account at purchase confirmation.
- The subscription renews automatically unless canceled at least 24 hours before the end of the current period.
- Renewal is charged within 24 hours before the end of the current period.
- You can manage and cancel your subscription in your App Store account settings.
Prices, durations, and any trial periods are shown in the App before purchase.
5. Account and Data
Some features may require a user account. You are responsible for the accuracy of the information you provide and for keeping your credentials confidential.

The Publisher is solely responsible for maintenance and support of the App.

8. Warranties
Except where mandatory law provides otherwise, the App is provided "as is" and "as available" without express or implied warranties, including warranties of merchantability, fitness for a particular purpose, or non-infringement. If the App fails to conform to applicable legal warranties, you may notify Apple; Apple may, where applicable, refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation regarding the App.
9. Liability
To the extent permitted by law, the Publisher is not liable for indirect, incidental, special, punitive, or consequential damages, or for loss of data, revenue, or profits resulting from use of the App. Nothing in this EULA limits mandatory consumer rights.
10. Product Claims
The Publisher, not Apple, is responsible for addressing any End User claims relating to the App, including in particular:
- product liability claims;
- non-compliance with applicable legal or regulatory requirements;
- claims under consumer protection, privacy, or similar laws.
11. Intellectual Property and Infringement
If a third party claims that the App or your use of the App infringes intellectual property rights, the Publisher, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.
12. Legal and Export Compliance
You represent that you are not located in a country subject to U.S. embargo and are not listed on any prohibited or restricted party list by competent authorities. You agree to comply with all applicable export laws.
13. Termination
This EULA remains in effect until terminated. It terminates automatically if you fail to comply with its terms. Upon termination, you must stop all use of the App and delete all copies in your possession.
14. Third-Party Beneficiary (Apple)
You acknowledge that Apple and its subsidiaries are third-party beneficiaries of this EULA and that, upon your acceptance of this EULA, Apple has the right to enforce this EULA against you as a third-party beneficiary.
15. Governing Law
This EULA is governed by French law, subject to mandatory consumer protection provisions applicable in your country of residence.
